OFFICIAL CONTEST RULES

  1. NO PURCHASE OR ONLINE SUBCRIPTION NECESSARY TO ENTER OR WIN. PURCHASE DOES NOT INCREASE CHANCE OF WINNING
  2. SPONSOR: Ford Motor Company, 16800 Executive Drive, Dearborn, MI 48126 (the “Sponsor”).
  3. ADMINISTRATOR: innovative Customer Management Solutions, Inc. (iCMS and/or “Administrator”), 2328 Alger Drive, Troy, MI 48083.
  4. CONTEST DESCRIPTION: THE MY FORD VIDEO CONTEST (THE “CONTEST”) IS OFFERED ONLY IN, AND MAY BE ENTERED ONLY FROM, THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA (“U.S.”). The Contest submission period for eligible videos shall begin at 12:01 AM Eastern Daylight Time (EDT) on April 24, 2009 and all entries must be received by 11:59 PM EDT on June 30, 2009 (“Contest Period”). Beginning on July 7, 2009, through July 21, 2009, the Top 5 Video Entries will be posted on www.youtube.com and www.myfordmag.com (the “Contest website”) where the general public will vote on the Contest Web Site at www.myfordmag.com for their favorite video entry as further defined below (the “Voting Period”).
  5. ELIGIBILITY: THE CONTEST IS OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES AND DISTRICT OF COLUMBIA ("U.S.") WHO ARE 18 YEARS OF AGE OR OLDER AT TIME OF ENTRY. Employees, and their immediate families (spouses and siblings, parents and children and their spouses) and household members of the Sponsor, Time Inc., iCMS and their respective affiliates, subsidiaries, divisions, dealers, advertising and promotion agencies (“Contest Entities”) are not eligible. Void in Puerto Rico and where prohibited.
  6. AGREEMENT TO THE OFFICIAL RULES: By participating in the Contest, each entrant fully and unconditionally accepts these Official Rules and the decisions of Sponsor and Administrator, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein. Noncompliance with the Official Rules will result in disqualification of an entrant and/or entrant’s subsequent Video Entries and the forfeiture of any prize.
  7. ENTRIES & JUDGING CRITERIA: Each Video Entry as further defined below shall demonstrate devotion to Ford with the Video Entry being of a serious or humorous nature, last 15 to 30 seconds in length and include the phrase "Ford. Drive One." Judging criteria will include Creativity 40%, Originality 20%, Composition 20%, and Quality of Execution 20%. Video Entries must not contain any: (i) sexually explicit, vulgar, obscene, pornographic, illegal, threatening or harassing or profane content; (ii) 3rd party trademarks, logos, insignia, location signage, photographs, artwork or sculptures except Ford related marks, insignia, location signage, photographs, posters, artwork etc.; (iii) use of names, likeness, photographs, or any other identifying elements in whole or in part, of any person, living or deceased, without the appropriate permissions (proof of which must be provided to the Contest Entities upon request); (iv) music of any kind or nature; or (v) any other material or content in any form or medium not owned by the entrant. Sponsor reserves the right to deem which Video Entries may be considered inappropriate
  8. HOW TO ENTER: THERE IS ONE WAY TO ENTER THE CONTEST: 1) INTERNET – Complete the online contest entry form on the Contest Web Site at www.myfordmag.com, and submit a video which is no less than 15 seconds but not more than 30 seconds in length in the following file formats: *.mp4, *.wmv, *.mov and*.avi up to 10MB (the "Video Entry" or "Video Entries"). Submit as directed during the Contest Period. No other method of submission of the Video Entries shall be accepted. Entry will not be complete until the Entrant has followed the onscreen prompts to upload and attach the Video Entry and you reach a “thank-you page” on the Contest website and Entrant affirmatively accepts the Official Rules by clicking on the “I have read and agree to the terms of the Contest Rules” button. Each entrant represents and warrants as follows: (i) the Video Entries are the entrant’s own original, previously unpublished and previously un-produced work; (ii) the Video Entries do not and will not violate or infringe upon the intellectual property rights or other rights of any other person or entity; (iii) the Video Entries do not and will not violate any applicable laws and are not and will not be defamatory or libelous. Each entrant agrees to indemnify and hold harmless the Contest Entities from and against any and all third-party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising from any breach of or alleged breach of any warranties, representations or agreements by the entrant hereunder, or from entrant’s participation in the Contest. Every Video Entry submitted, regardless of number, is eligible to win a prize. Multiple Video Entries generated by a script, macro or other automated means, however, will be disqualified. In case of dispute as to the owner of an online Video Entry, online Video Entry will be deemed to have been submitted by the authorized account holder of the e-mail address from which the entry is made. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Video Entries that are incomplete or corrupted are void. Sponsor is not responsible for late, lost, illegible or damaged Video Entries. Video Entries become the property of the Sponsor and will not be returned. By your submission of the Video Entries and the same being reviewed and evaluated for this Contest, each entrant that submits Video Entries into the Contest hereby irrevocably grants, transfers, sells, assigns and conveys to the Sponsor, their successors and assigns, all present and future rights, title and interest of every kind and nature whatsoever, including, without limitation, all copyrights and all incidental, subsidiary, ancillary or allied rights, including, without limitation, all derivative, display, reproduction, distribution and performance rights in and to the Video Entries for exploitation throughout the world, in perpetuity, by means of any and all media devices, whether now known or hereafter become known, and whether in print or electronic form or medium, and as a result, the entrant does not retain any rights in and to the Video Entries.
  9. PRIZES/APPROXIMATE RETAIL VALUE (ARV): One (1) First Prize: Trip for two to Miami including coach-class airfare, accommodations for 4 days/3 nights (1 room with 2 double beds, only two persons to a room), a 2010 Ford Mustang rental car at no expense to the First Prize Winner other than any applicable insurance associated with the use of the vehicle and $500 spending cash (ARV $2,900) will be awarded. The First Prize package may include round-trip coach-class airfare for two (2) from a major airport near the winner’s home (as determined by Sponsor). One (1) Second Place Prize: Sony VAIO Lifestyle PC (ARV $900.00) will be awarded. One (1) Third Place Prize: Sony Ericsson phone and Bluetooth car speaker (ARV $370.00) will be awarded. For First Prize Winner, Sponsor will determine flight itinerary and airline. First Prize Winner and travel companion must travel on same itinerary. The First Prize Winner’s travel companion must be at least 18 years of age and not a minor in his or her state and must sign the Liability/Publicity Release prior to travel. No refund or compensation will be made in the event of flight delay or cancellation. Travel is subject to the conditions of the respective airline, airport and hotel. If in the judgment of Sponsor air travel is not required due to the First Prize Winner’s proximity to the event, other transportation will be substituted at Sponsor’s sole discretion. First Prize Winner and travel companion will be responsible for all other transportation, meals, incidentals, duties, fees, hotel charges, parking and gratuities and all other expenses not specifically set forth herein. Contest Entities will not obtain travel insurance on behalf of the First Prize Winner or travel companion. First Prize Winner must obtain, at his or her expense, insurance in connection with the use of the 2010 Ford Mustang rental car, with such use of the rental car not exceeding 500 miles of driving and further subject to the applicable rental car terms and conditions, and First Prize Winner must be a licensed driver. Contest Entities will not replace any lost or stolen tickets, travel vouchers, or certificates. Once travel commences, no unscheduled stopovers are permitted; if an unscheduled stopover occurs, full fare will be charged from stopover for the remaining segment, including return, of the trip. Contest Entities are not liable for any expense incurred as a consequence of flight cancellation/delay. All air transportation tickets are subject to the vagaries of flight variation, work stoppages and schedule and route changes. ARV for travel prizes may vary, depending upon points of departure and destination and fare fluctuations. The First Prize Winner will not receive cash or any other form of compensation if actual travel costs are less then the ARV indicated in these Official Rules. All specifics are within the Sponsor’s sole discretion. The First Prize trip must be taken before July 23, 2010 and travel from November 17–23, 2009 and December 17, 2009 through January 4, 2010 will not be allowed. All other requested travel dates will be approved at the discretion of the Sponsor. Winners may not transfer, exchange or redeem any Prizes for cash. No substitution may be made, except by Sponsor, who reserves the right, in its sole discretion, to substitute a prize with another prize of comparable or greater value. Winners are solely responsible for any and all applicable fees and taxes. Prizes awarded may differ from any prizes shown in promotional materials. Actual color/size of prizes will be determined by Sponsor. The odds of winning depend on the total number of eligible entries received. Limit one prize per family, household and/or person. All prizes and all portions of a prize are awarded WITHOUT WARRANTY OF ANY KIND, express or implied, without limitation.
  10. PUBLIC VOTING, WINNER SELECTION AND VERIFICATION: Sponsor shall select the Top 5 Video Entries from all eligible entries received during the "Contest Period" based on the judging criteria identified above. Odds of becoming a Finalist depend on the number of eligible Video Entries received and the skill demonstrated in Video Entries relative to the judging criteria identified above. Those 5 entries will be deemed the 5 finalists, and their Video Entries will be displayed on the Contest Website at www.myfordmag.com and at www.youtube.com on July 7, 2009. The public will then vote on the Contest Website only, at www.myfordmag.com based on the judging criteria disclosed above to select the First, Second and Third Prize winners. Voting will end on July 21, 2009. Public voters will have the ability to evaluate and vote a maximum of once per 24-hour period during the Voting Period. Subsequent votes in excess of the stated maximum voting per 24 hour period by a single voter will be disqualified. Entrants are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public or as determined by the Contest Entities in their sole discretion. Use of script, macro or any automated system to vote or with the intent to impair the integrity of the voting process is prohibited and all such votes will be void and further, may disqualify the applicable Video Entries. The top 3 entries with the highest total votes at 11:59 pm EDT on July 21, 2009 will be the official First, Second and Third Place Prize winners, respectively, and shall be final and binding. In the event of a tie for determining the Winners, all tied Video Entries will be judged by an independent judging organization selected by the Sponsor, using the judging criteria set forth above, to break the tie. Odds of a Finalist being declared a Contest Winner will be no worse that 3:5 and will depend on the quality of the Video Entries as judged by the independent judging organization. The potential First Place, Second Place and Third Place Prize Winners will be announced online on or about August 3, 2009.
  11. NOTIFICATION OF POTENTIAL WINNERS: The potential First Prize, Second Place and Third Place Prize Winners will be notified within seven (7) days of selection by telephone, mail and/or e-mail or other electronic means. The Potential First Place, Second Place and Third Place Prize Winners must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all said requirements. The Potential First Place, Second Place and Third Place Prize Winners are not winners until they have completed, signed and returned all required documentation, including, but not limited to an Affidavit of Eligibility, Publicity Release, Liability Waiver and Sponsor has verified eligibility, prior to any travel, if applicable. Potential winning entrants of the First Place, Second Place and Third Place Prize will have seven (7) days from receipt of winning notification to complete all necessary forms by mailing to “2009 MY FORD VIDEO CONTEST,” c/o ICMS, P.O. Box 7060, Troy, MI 48007-9615. If a prize notification is refused or returned as undeliverable, or if a potential First Place, Second Place and Third Place Prize Winner fails to timely return the properly executed documentation within the specified time period, chooses to decline the prize for any reason, or fails to comply with these Official Rules, the potential First Place, Second Place and Third Place Prize Winner will be disqualified and another eligible entrant may be selected. If the potential winner cannot be contacted within 3 days, the potential winner may be disqualified and alternate entrant may be selected. Except where prohibited by law, entry constitutes permission for Sponsor to use entrant's name, entry picture, home town, likeness, statements and other personally identifiable information for advertising and marketing of Sponsor's products, services and consumer promotions in any media throughout the world without additional prize, incentive, consideration, consent or review; and upon request, winner will provide written consent to such use. If a prize is refused, a prize notification is returned or deemed undeliverable, or a potential winner is disqualified for any reason, an alternate winner will be selected. All decisions of Sponsor and/or judges shall be binding and final.
  12. RELEASE AND DISCLAIMER OF LIABILITY: Sponsor, Administrator, and Contest Entities are not responsible for 1) any error, omission, interruption, deletion, defect, delay in operations or transmission, theft, destruction or unauthorized access to or alterations of entry materials or any human errors; 2) technical, network, telephone, computer, hardware or software malfunctions of any kind, or inaccurate transmission or processing of, or failure of Sponsor or agents to receive entry information on account of technical or any combination thereof; 3) any injury or damage to entrant's or any other's person or property or system occasioned by the entrant during the Contest or from downloading or uploading any information necessary to enter the Contest or resulting from participation in the Contest; 4) entries or mail that are late, lost, misdirected, illegible, damaged, or otherwise deficient. Sponsor reserves the right, in its sole discretion, to terminate, cancel, suspend or modify the Contest in its entirety, or any portion thereof if its integrity, fairness or proper operation is undermined, or corrupted as a result of technical or other reasons or because of any illegal or non-authorized intervention or any other factor beyond Sponsor’s reasonable control. In that event, Sponsor may select the grand prize winner(s) from all eligible entries received prior to such modification or cancellation. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. By entering, participants (a) agree to be bound by these Official Rules and the decisions of the Sponsor, Administrator, which shall be without legal or other recourse and final in all respects; (b) release Sponsor, Administrator, Contest Entities and their respective divisions, dealers, subsidiaries, affiliates, and advertising and promotion agencies and their respective directors, officers, agents and employees from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the prize; and (c) acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize.
  13. PRIVACY: Unless prohibited by law, information collected in connection with this Contest may be shared with Sponsor's promotional partners if and to the extent entrants agree at the time of entry, and in such event, the use of such information by such promotional partners will be used in accordance with such partners' respective privacy policies. Except as otherwise contemplated in these Official Rules, information collected in connection with this Contest will be used in accordance with Sponsor's privacy policy. By entering this contest, you are agreeing to the privacy statement located at www.myfordmag.com.
  14. DISPUTES: Entrants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Oakland County, Michigan, USA. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants’ rights and obligations or the rights and obligations of the Sponsors in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan USA. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event, shall include attorney fees.
  15.
